My Lingo Terms & Conditions

 General Disclaimer 

a.       Engaging with the MyLingo PTY LTD website such as reading and/or browsing the MyLingo PTY LTD website indicates that you agree and understand to be bound by the terms and conditions. If you disagree with the terms and conditions, you must immediately discontinue engaging with the website and its services.

b.      MyLingo PTY LTD is not liable to you or anyone else for damage or loss (including negligence directly or indirectly) to the extent permitted by law, with the use of MyLingo PTY LTD website, services or linked websites and services.

c.       The use of trademarks, trade names, service marks and any other products/logos and service of MyLingo PTY LTD or related to, must be referenced correctly to us ‘MyLingo PTY LTD’. The use of our trademarks must NOT:

a.       Form partly or wholly of your own trademark;

b.      Linked or connected with services, products or any activities that are not belonging to you;

c.       In any matter that is confusing, deceitful or misleading; and

d.      That denigrates MyLingo’s activities, products, services including information that we provide on MyLingo’s website.    

d.      We reserve the right to change, review and update terms at the sole discretion of MyLingo PTY LTD.  When MyLingo updates terms and conditions, every effort will be made to provide the user with reasonable notice of updates to the terms and conditions as these will take effect immediately from the date of publication. These may include and are not limited to: SMS, emails, in-app messages including push notifications, regular post, telephone or other means of communication developed in the future. If access to the service is an authorised manner, you consent to receiving communications by any and all forgoing means. You should look at the terms and conditions regularly.

e.       You agree that MyLingo PTY LTD may be required to review content submitted to its services to ensure that submitted content does not violate terms or is unlawful content. If in violation of the law, your content maybe deleted, modified, prevent your access and displaying of the content. MyLingo PTY LTD does not have an obligation to continue to monitor/review any content that is submitted to the website.

f.        MyLingo PTY LTD does not have a relationship with owners or operators of any linked websites that appear on the MyLingo PTY LTD website and we have no control over them.

b.      Children under 18 years of age

a.      MyLingo PTY LTD is intended for people over the age of 18 years and children under the age of 18 are prohibited from using website or services. Should we become aware of an age infringement MyLingo PTY LTD reserves the right to remove the information regarding the child.

c.       Acceptance of Terms

a.      You may click the box to agree and accept the terms and conditions where this option is available, however, by remaining on the website, this is considered acceptance of the terms and conditions

b.      You agree and give consent to MyLingo PTY LTD User Agreements and MyLingo Policies.

c.       You agree and give consent to all forms of payment services including but not limited to cryptocurrency or other such forms of payment that may occur in the future to share specific information about you and our account aligned with MyLingo PTY LTD Privacy Policy.

d.      You expressly consent to specific content being used by MyLingo PTY LTD websites tracking methods. This extends to cookies and transmission of personal data outside of Australia and aligns with our Privacy Policy.

d.      User Conduct – You must NOT:

a.      Upload or share any content that is abusive, defamatory, vulgar, threatening, obscene, invasive of and to another party including privacy, racially, ethnically or hateful and harmful content to another person/s.

b.      Impersonate another and/or attempt to fraudulently alter the identifiers of content transmitted through the service.

c.       Infringe upon copyrighted materials including patents, trademarks, logo’s without the permission of the owner/author. Subject to the conditions of the applicable law that apply in your location.

d.      Gain unauthorised access to the service/s for the purposes of interrupting and/or destroying computer codes, files, content and programs used by the service and users for commercial purposes unless expressly stated.

e.       Access the servers or services for the purpose of disruption and interference to the network and other users.

f.        Advertise or solicit content without prior permission.

e.       Termination of your account

a.      You agree that MyLingo PTY LTD can terminate your account immediately without notice to you and/or suspend or limit your account at our discretion for any reason and at any time.

b.      If the terms in this agreement are violated, termination of your account may be for the following reasons, and not limited to, (a) Breach of Terms and Conditions (b) technical and security issues (c) fraudulent and illegal activities by you, (d) extended periods of inactivity.

c.       If your account is terminated, you will no longer have rights or access to the website, services or content including your account.

d.      You may terminate your account at any time by submitting a termination request to MyLingo PTY LTD contact us page.

f.        Fees

a.      If fees exist or will in the future, MyLingo PTY LTD reserves the right to charge fees for access to services and use of the service. Notice will be provided should a fee be charged and MyLingo payment terms and conditions will apply.

b.      Whatever the preferred method of payment, you agree that the user agreement will be a contract between you and the payment service and they will govern your use of your account and services. Payment services terms and conditions apply in addition to MyLingo PTY LTD terms and conditions. Please refer to these.

g.      Refunds

a.      If fees come into existence, and a refund applies, this will be made by refunding back to the account it was paid from within a reasonable timeframe.

h.      Unsubscribe

a.      At any stage you have to right to unsubscribe should you not wish to receive communication from us or to change your communication preferences.

b.      Offers and/or promotions including services, changes and new products may be communicated to you. In addition to this, related entities and business affiliate offers may also be sent to you. You may also unsubscribe to receiving this information at no cost. 

i.        Feedback and email information

a.      If you elect to receive MyLingo PTY LTD communications, you will be added to our mailing list. Consent will be required from you to disclose details to third parties or if required under the law.

b.      Website support staff may monitor email messages for the purposes of maintenance and system trouble shooting.

j.        Indemnification

a.      You agree to indemnify MyLingo PTY LTD and its affiliates and/or using the services on behalf of a company or for commercial purposes, you will hold harmless and indemnify MyLingo PTY LTD against legal claims and demands arising from the use or breaches of our services including claims for negligence, losses, damages, judgements, legal fees and litigation costs.

k.      Warranties and disclaimers

a.    To the fullest extent permitted by the applicable law, we do not make any of the following about the services/activities/products we provide:

4.   Express/implied terms about the services/activities/products

b.    Our services are provided ‘as is’.

c.    The use of our services including the content cannot be guaranteed to be uninterrupted, error free or secure and we do not promise, warrant or represent that this will not occur. It is at your own risk.

l.        Websites and Apps

a.              The information contained on the MyLingo PTY LTD website is for general information purposes only.

b.             Any errors or an omission of the content on the service/activity/product is not the responsibility of MyLingo PTY LTD.

c.              MyLingo PTY LTD website may contain external links, not provided, maintained or affiliated in any way with MyLingo PTY LTD.

d.             Any information on these external websites is not guaranteed by MyLingo to be complete, relevant timeliness and/or accurate.

e.              Redirection to a third party site is at your own risk.

m.    Limitation on liability

a.              To the fullest extent permitted by the applicable law, you agree that MyLingo PTY LTD will not be liable for:

      1. Damages – indirect, incidental, consequential, special,

2. Loss, diminution in value of loss or personal information connected to the terms and conditions, use or access of the service.

      3. Any disputes that arise from the terms and conditions or misuse of MyLingo                            PTY LTD services/activities/products or website.

b.             Any reliance on the MyLingo PTY LTD website and content is at your own risk and you indemnify us from any loss or damage suffered by you.

c.              MyLingo PTY LTD is not responsible or control what other people do or say. We are not responsible for actions or conduct of others (on or offline) or any content that is shared. However, we are committed to ensuring our website (services/activities/products) are professional and legally abiding.
